Supreme Court of Arkansas
Arkansas Department of Correction and Wendy Kelley
March 29, 2018541 S.W.3d 410
Summary
The court held that the confidentiality provisions governing lethal-injection information do not protect the identity of drug manufacturers, so the ADC could not withhold potassium-chloride labels and package inserts on that basis. The court nevertheless held that information such as lot, batch, and control numbers must be redacted when it could identify sellers or suppliers. It affirmed in part, reversed in part, and remanded for the circuit court to determine the required redactions.
