Summary
The court held that Green’s sentences were facially illegal because they exceeded the applicable statutory maximums, regardless of whether he was sentenced as a habitual offender. It reversed the denial of relief and remanded for the circuit court either to reduce the sentences or properly designate habitual-offender sentencing and adjust the theft sentence. The court separately held that the Arkansas Department of Correction’s parole-eligibility calculation was not cognizable under the statute and denied Green’s motion for appointment of counsel.
