Supreme Court of Arkansas
Jane Lipscomb Stone
March 16, 20172017 Ark. LEXIS 82
Summary
The court affirmed the circuit court’s orders quieting title to the hospital property in Washington Regional Medical Center and granting summary judgment, while vacating the court of appeals’ opinion. It held that the later deed terminated the Stone heirs’ reversionary interest, leaving them without standing to enforce the charitable trust, and that the medical center established the elements of a quiet-title action. The court also held that the dissolved hospital corporation was not an indispensable party. Justice Hart, joined by Justice Baker, concurred in part and dissented in part, arguing that the court should not have reached the quiet-title issues and that the majority’s analysis of those issues was incorrect.
