Summary
The court held that the City and its employees did not establish statutory immunity because they failed to prove the absence of liability insurance, and it affirmed denial of summary judgment on Yang's negligence claims against them. It held that the insurance policies in the record established MEMS's coverage and required summary judgment for MEMS to the extent its liability exceeded that coverage, so it reversed and remanded on that issue. Justice Wood, joined by Justice Womack, concurred in part and dissented in part, concluding that MEMS also failed to meet its burden because it had not presented the policies in support of its oral adoption of the City's motion.
