The court held that Ruiz did not state a colorable due-process claim because Arkansas law creates no liberty interest in parole eligibility. It held, however, that his nonconclusory allegations sufficiently stated a colorable ex-post-facto claim because he alleged that retroactive application of a later parole statute extended his incarceration by two years. The court therefore affirmed in part, reversed in part, and remanded so Ruiz could proceed in forma pauperis and obtain review based on the complete administrative record.
