Justice Baker concurred in affirming the adoption decree, concluding that Lagios did not fall within the statutory categories requiring his consent and could not challenge the notice provision because it did not apply to him. She also concluded that the statutory notice requirement was satisfied on the facts because the deceased parent's father was deceased, the mother was unavailable, and notice was nevertheless provided to the next of kin. Justice Hart, dissenting, would have required strict compliance with the adoption statutes and would have treated Lagios's parental-rights and due-process objections as requiring reversal.
