Supreme Court of Arkansas
Melanie Conway, M.d. v. Mark…
September 22, 20162016 Ark. LEXIS 267
Summary
The court held that the ballot title for the Arkansas Medical Cannabis Act was legally sufficient and denied Conway's petition to prevent certification of votes on the measure. Applying the requirement that a ballot title provide an impartial and intelligible summary without misleading omissions or partisan coloring, the court rejected each of Conway's six challenges. The court also permitted ACC to intervene and concluded that its motion to dismiss the original petition was moot after Conway filed an amended petition.
