Supreme Court of Arkansas

Makkali v. Kelley

March 31, 20162016 Ark. 137

Summary

The court held that a habeas petition based on scientific evidence was properly filed in the circuit court where the conviction was entered, notwithstanding the petitioner's incarceration in another county. Because the petition alleged that untested DNA evidence supported relief under the scientific-evidence habeas statute, the dismissal for lack of jurisdiction was reversed and the matter was remanded. No separate opinions were filed.
