Supreme Court of Arkansas

Hinkston v. State

January 7, 20162016 Ark. 4

Summary

The court dismissed Hinkston’s appeal from the denial of his habeas-corpus petition because the Crawford County Circuit Court lacked jurisdiction over a prisoner incarcerated in Lee County and because his claims were procedurally barred under Rule 37. The court held that the petition was properly treated as a Rule 37.1 petition, which was untimely and successive. Hinkston’s motions for an extension of time and for mandamus were therefore moot.
