The dissent would have held that the undisclosed police video was material to Thacker’s potential self-defense claim because it showed plainclothes officers entering without announcing their identity immediately beforehand. It therefore concluded that Thacker’s coram nobis petition was not clearly meritless and that the circuit court should have conducted a hearing before denying it. Justice Danielson joined the dissent.
