Summary

Because the circuit court denied class certification solely because Convent presented no evidence at the hearing, without considering admissible exhibits in the record or applying the Rule 23 requirements, the court reversed and remanded. Justice Rhonda K. Wood, dissenting, would have affirmed because Convent was no longer a member of the proposed class after dismissal of the claims underlying that class.
