Summary
Justice Wood concurred in the majority's judgment but separately argued that the parents' ineffective-assistance claims were untimely because they were raised more than ninety days after the adjudication order. She also reasoned that the prior adoption of the criminal ineffective-assistance standard was dicta and encouraged consideration of a fundamental-fairness standard better suited to dependency-neglect proceedings. Justice Hart, dissenting, would reverse and remand for an unbiased judge and a new adjudication hearing, while Justice Danielson would reverse and remand based on ineffective assistance and the failure to advise the parents of their appeal rights.
