The court reversed and remanded the order granting habeas relief because the circuit court did not expressly determine probable cause or complete the statutory habeas procedures before vacating Hodge's sentence. The court therefore did not decide whether the juvenile-sentencing rule invoked by Hodge applied retroactively. Justice Wood, dissenting and joined by Justice Wynne, would have reached the retroactivity issue because Hodge's age was undisputed and the State effectively conceded that he was under eighteen.
