Supreme Court of Arkansas
Naeem Rasul, Appellant v. State of Arkansas, Appellee
March 19, 20152015 Ark. LEXIS 140
Summary
The court affirmed the denial of postconviction relief, holding that the appellant failed to establish reversible ineffective assistance concerning either the omission of self-defense instructions for lesser-included offenses or the failure to call a separate PCP expert. The jury-instruction argument was also not preserved because the appellant did not make his legal challenge to the prejudice analysis in the circuit court. The court concluded that the medical examiner’s testimony made the proposed expert testimony cumulative and that the circuit court’s factual findings were not clearly erroneous.
