Supreme Court of Arkansas
Kenneth Isom, Appellant v. State of Arkansas, Appellee — Danielson, J., Dissenting
May 21, 20152015 Ark. LEXIS 357
Summary
Justice Danielson dissented from the majority's decision to permit Isom to seek coram nobis relief, concluding that his proposed Brady-based attack was not sufficiently meritorious. He reasoned that the alleged evidence concerning scissors and other suspects was either known to trial counsel or insufficiently material and prejudicial to show that the judgment would have been prevented. Chief Justice Hannah and Justice Goodson joined the dissent, which would have denied the petition to reinvest jurisdiction.
