Supreme Court of Arkansas

Howard Wood, Appellant v. State of Arkansas, Appellee — Hart, J., Dissenting

December 17, 20152015 Ark. LEXIS 675

Summary

The dissent would hold that summary denial of Wood's post-conviction petition violated Rule 37.3 because the record did not conclusively establish that he was entitled to no relief. It particularly concludes that Wood's PTSD allegations raised a fact question about whether his condition affected his decision to plead guilty and warranted review of his medical records and an evidentiary hearing. The dissent would reverse and remand for that hearing.
