Summary
The court upheld most challenged provisions of Act 1413 governing initiative and referendum petitions, concluding that requirements imposed on paid canvassers, petition signers, sponsors, and verification officials were authorized measures to facilitate the petition process and prevent fraud. It invalidated the provision barring circulation and collection of additional signatures after initial filing and the provision invalidating an entire petition part containing signatures from multiple counties. The court therefore affirmed in part and reversed in part. Justice Hart, joined by Justices Baker and Goodson, would have invalidated the Act in its entirety, while Justice Wood, joined by Chief Justice Hannah, would have upheld the entire Act.
