Supreme Court of Arkansas

Cheri Suzanne McCoy, Appellant v. Vernon Jeffrey Kincade, Appellee

October 29, 20152015 Ark. LEXIS 612

Summary

The Supreme Court of Arkansas affirmed modification of the parties’ joint-custody arrangement to place the children primarily with their father. It held that the mother’s relocation, the children’s maturation and resulting school and social commitments, the parents’ remarriages, and strained parent-child relationships collectively supported a material change in circumstances, after which the circuit court could consider the children’s best interests. Justice Self, concurring, would have found a material change based solely on both parties’ pleadings seeking to end the joint-custody arrangement.
