Summary
The court held that Garrett was not disqualified from unemployment benefits because the evidence did not establish that her failure to obtain a certification testing date was intentional or sufficiently negligent to constitute misconduct. Although she submitted her application near the deadline, the employer's incomplete paperwork prevented her from obtaining a testing date, and the employer acknowledged that she could have remained employed if she had obtained such a date. The court therefore reversed the Board's decision, remanded for an award of benefits, and vacated the court of appeals' opinion.
