Supreme Court of Arkansas

Entergy Arkansas, Inc.; Entergy Operations, Inc.; and Dp Engineering, Ltd. Co., Petitioners v. Pope County Circuit…

December 11, 20142014 Ark. LEXIS 642

Summary

The court granted writs of prohibition because the circuit court lacked jurisdiction to decide whether Entergy and DP were employers or otherwise immune under the Arkansas Workers’ Compensation Act. Those employer-status and immunity questions involved factual disputes that the Workers’ Compensation Commission had exclusive original jurisdiction to determine, and the facts were not so one-sided as to present only a question of law. Justice Karen R. Baker, dissenting, would have denied the writ because she viewed the undisputed facts as conclusively establishing that PSC was Walters’s only employer.
