Supreme Court of Arkansas

Eddie Silver Watkins, Appellant v. State of Arkansas, Appellee

June 19, 20142014 Ark. LEXIS 373

Summary

The court affirmed the denial of Watkins's habeas petition because he failed to show that the circuit court lacked subject-matter jurisdiction or that his judgments were facially invalid. Although Watkins claimed the forged checks were cashed outside Hot Spring County, he admitted that the forgery scheme began there, allowing either county to exercise jurisdiction over the offense. The court also held that any ineffective-assistance claim concerning his guilty plea was not cognizable in habeas proceedings and had to be raised under Rule 37.1.
