Supreme Court of Arkansas

Arkansas State Board of Election Commissioners and Doyle Webb

May 16, 20142014 Ark. LEXIS 367

Summary

Justice Baker dissented from the majority's affirmance of the circuit court's ruling concerning election rules implementing voter-identification requirements. She agreed that the circuit court erred in addressing the constitutionality of Act 595 but concluded that the majority could not apply the right-result-wrong-reason doctrine because the majority's ruling would produce a materially different result for absentee ballots. She would have reversed and remanded for further proceedings, and Justice Hart joined the dissent.
