Supreme Court of Arkansas
State of Arkansas v. V.h. — Hoofman, J., Dissenting
September 26, 20132013 Ark. LEXIS 412
Summary
Justice Hoofman dissented, concluding that the State's appeal in this juvenile-delinquency matter was not authorized because juvenile appeals are permitted only under circumstances that would allow a State appeal in a criminal proceeding. He reasoned that the State failed to comply with the attorney-general review and record-lodging requirements and that the appeal did not arise from a misdemeanor or felony prosecution or a permitted interlocutory appeal. Justices Baker and Hart joined the dissent.
