Supreme Court of Arkansas

Newton W. Dorsett and Diamond Transport & Drilling, LLC, Appellants v. Donald Buffington and Richard Williamson…

September 26, 20132013 Ark. LEXIS 421

Summary

The court held that the Louisiana judgment did not bar Buffington’s Arkansas claims because damages could not have been sought in the Louisiana summary proceeding and the judgment expressly reserved future claims. It upheld the jury’s lost-profits award for breach of contract and the conversion verdict, but reversed the award of prejudgment interest because the damages were not ascertainable with sufficient certainty as to both amount and time. The judgment was therefore affirmed in part and reversed in part.
