Supreme Court of Arkansas

Ford Motor Company, Appellant v. Paulette R. Washington

December 12, 20132013 Ark. LEXIS 604

Summary

Justice Goodson dissented from the majority's affirmance of the circuit court's exclusion of evidence that the decedent was not wearing a seat belt. She reasoned that Ford's expert testimony satisfied the statutory requirements by addressing noncompliance, injury reduction, and the extent of that reduction, and that Washington's seat-belt evidence opened the door to rebuttal. Justices Baker and Hart joined the dissent.
