Supreme Court of Arkansas

Partne A. Daugherty v. Jacksonville Police Department Gary Sipes, as Jacksonville Police Chief and Gary Fletcher…

June 14, 20122012 Ark. LEXIS 283

Summary

The court held that the police department violated the Freedom of Information Act by refusing the first request as too broad or burdensome and by charging personnel time for producing ordinary copies of electronically stored recordings. The court upheld the finding that the department did not negligently violate the Act by purging recordings under its routine forty-five-day retention policy, and it declined to consider an unpreserved argument based on a separate records-retention statute. The judgment was therefore affirmed in part and reversed and remanded in part.
