Supreme Court of Arkansas
Hpd, LLC v. Tetra Technologies, Inc.
November 1, 20122012 Ark. LEXIS 427
Summary
The court held that the parties clearly and unmistakably delegated questions concerning the existence, validity, and scope of the arbitration agreement to the arbitrators. The broad arbitration clause, its incorporation of rules authorizing arbitrators to decide their own jurisdiction, and the clause requiring arbitration to the exclusion of any court collectively required arbitration of all existing disputes. The court reversed and remanded for an order compelling arbitration, rendering TETRA's cross-appeal moot.
