Summary

The court held that the post-indictment legal-services agreement was oral and therefore subject to the three-year statute of limitations. Although the later security agreement acknowledged an existing debt and restarted the limitations period, it did not convert the underlying oral agreement into a written obligation subject to the five-year period. The court reversed the summary judgment order and dismissed the action as untimely.
