Summary

The court reversed the superior court’s order granting post-conviction relief and affirmed Greene’s death sentence. It held that the 2019 amendments narrowing the pecuniary-gain aggravating circumstance were prospective only, did not eliminate death-penalty eligibility for Greene’s robbery-murder conduct, and did not render his sentence unconstitutional under either the federal or Arizona Constitution. The court also held that none of the asserted post-conviction-relief provisions supplied a basis for relief because the sentence was lawful when imposed and remains constitutionally valid.
