Advanced Property Tax v. Jorge Othon and Spouse

Summary

The court held that Othon could not collaterally attack, in a quiet title action, the default judgment entered against the record owner in a separate tax-lien foreclosure action. Othon's buyer-seller relationship with the former owner was not analogous to the insurer-insured relationship that can permit a nonparty to challenge a default judgment, and equitable considerations did not warrant relief. The court reversed the trial court and vacated the court of appeals' decision.
