Summary

The court held that recording a notice of trustee’s sale does not, by itself, accelerate a debt secured by a deed of trust. Because the loan documents required notice to invoke the optional acceleration clause and the notices contained no such language, the statute of limitations was not triggered by the 2009 notices. The court reversed the trial court and remanded for entry of summary judgment in favor of Nationstar.
