Arizona Supreme Court
Jessie D. v. dcs/f v. m.D./m.D./c.D.
October 8, 2021
Summary
The court affirmed termination of the father's parental rights under the felony-incarceration ground because reasonable evidence supported the findings that his seven-year sentence would deprive the children of a normal home for years and that termination was in their best interests. Although the juvenile court misapplied two factors concerning the existing relationship and maintaining that relationship during incarceration, the remaining factors and the record supported the termination. The court also held that, when requested and safe for the child, the Department must make reasonable efforts to provide reunification services to incarcerated parents facing termination under this statutory ground.
