Arizona Supreme Court
Diannah Dinsmoor v. City of Phoenix
August 6, 2021
Summary
The court held that the school district and its personnel owed no duty to protect Ana from being killed by Matthew because no known and tangible risk to Ana arose while she was under the school’s custody and control. The school-student special relationship generally imposes a protective duty only for risks arising within the relationship’s temporal and geographic scope, although unusual circumstances may extend the duty to off-campus harm caused by an on-campus risk. The court affirmed summary judgment for the district and vacated specified portions of the court of appeals’ opinion.
