Summary

The court held that the parties’ embryo-disposition agreement required donation of the embryos if they could not contemporaneously agree to unilateral use by one party. The agreement did not give the family court discretion to award the embryos based on a balancing of interests, and the court therefore vacated the contrary court of appeals decision while affirming the family court’s donation order.
