Summary
The court held that one-time payments for accrued sick leave made upon retirement are not "salary or wages" and therefore are not pensionable compensation under the City’s retirement plan. It also held that the City’s prior administrative practice and representations did not create independent contractual rights preventing prospective elimination of the practice for leave accrued after July 1, 2012. The court denied the employees’ fee request, awarded fees to the City, reversed the trial judgment, and remanded for entry of judgment for the City.
