Summary

The court held that De Anda’s consent to a warrantless blood draw was voluntary under the totality of the circumstances, even though the officer advised him of the consequences of refusal before asking whether he would submit to testing. The advisement did not claim that officers could compel testing and did not itself render consent involuntary. The court therefore affirmed the denial of suppression and De Anda’s convictions and sentences.
