Arizona Supreme Court
State of Arizona, Appellee v. Courtney Noelle Weakland, Appellant.
February 25, 2019246 Ariz. 67
Summary
The Court held that the good-faith exception permits admission of blood-test evidence obtained under Arizona's admin per se admonition after Butler but before Valenzuela II. Because appellate precedent continued to support the admonition and did not clearly establish that it was coercive, suppression would not meaningfully deter police misconduct. The Court vacated the court of appeals' decision and affirmed Weakland's convictions and sentences. Justice Pelander, dissenting, and Justice Bolick, joined by Chief Justice Bales, dissenting, would have held that Butler made reliance on the admonition alone objectively unreasonable and required suppression.
