Arizona Supreme Court

State of Arizona, Appellee v. Courtney Noelle Weakland, Appellant.

February 25, 2019246 Ariz. 67

Summary

The Court held that the good-faith exception to the exclusionary rule permitted admission of blood evidence obtained after an officer used Arizona's admin per se admonition following an arrest occurring after Butler but before Valenzuela II. Because appellate precedent continued to support the admonition and did not clearly make its use unconstitutional, police acted with objectively reasonable reliance and suppression would not meaningfully deter misconduct. The Court vacated the court of appeals' opinion and affirmed Weakland's convictions and sentences. Justice Pelander, dissenting, would have found the law unsettled after Butler, while Justice Bolick, joined by Chief Justice Bales, would have required express appellate authorization for using the admonition alone to establish consent.
