Arizona Supreme Court
State of Arizona, Appellee v. Andre Lee Juwaun Maestas, Appellant.
May 23, 2018417 P.3d 774
Summary
The court held that the political question doctrine did not bar review of whether the university-campus marijuana prohibition complied with the Voter Protection Act. It further held that the prohibition amended the voter-enacted medical-marijuana initiative and did not further that initiative’s purpose of protecting compliant cardholders from criminal penalties, making the prohibition unconstitutional as applied to Maestas. Justice Bolick, concurring, agreed with the result but questioned the continued use of the prudential branch of the political question doctrine.
