Arizona Supreme Court

Dale Allen Wright v. Hon. gates/state

October 4, 2017

Summary

The court held that solicitation to commit an enumerated dangerous crime against children is a second-degree dangerous crime against children, but enhanced dangerous-crime-against-children sentencing requires an actual child victim. Because Wright’s offenses involved fictitious children, the court reversed the trial court’s refusal to dismiss the dangerous-crime designation, vacated the appellate decision, and remanded. No separate opinions were filed.
