Summary

The court held that Arizona Rule of Evidence 407 excludes evidence of subsequent safety measures even when the actor lacked knowledge of the earlier accident or did not act in response to it. It also held that the evidence was not admissible for another purpose because it would have been used to establish negligence, rebut comparative fault, or impeach without directly contradicting the State's evidence. The court affirmed the judgment for the State and vacated the court of appeals' opinion.
