Summary
The Alaska Supreme Court affirmed summary judgment for the State on claims that a probation officer negligently supervised a probationer subject to a domestic violence protective order. The court held that the officer performed her nondiscretionary duty to investigate the alleged violations of which she had notice, and that her decision not to investigate further or pursue additional action was protected by discretionary function immunity. The court also recognized that the State owed a duty of reasonable care to foreseeable victims of probationers. The opinion contains no separate writings.
