Summary

The court held that Alaska Housing Finance Corporation is a state actor and that its nonjudicial foreclosure of Anderson’s home deprived him of a constitutionally protected property interest. Because AHFC provided no pre-deprivation opportunity for Anderson to present his objections to a neutral decision-maker, the foreclosure process violated due process, and the court reversed the superior court’s summary judgment ruling on that claim. The court also held that Anderson was not required to prove prejudice after being entirely denied a required hearing.
