Alaska Supreme Court
Allstate Insurance Company and Kathy Berry, Appellants v. Mary Kenick and Angelina Trailov, Appellees.
January 25, 2019435 P.3d 938
Summary
The court held that a federal declaratory judgment precluded the insured's assignees from relitigating whether the insurer and its adjuster acted reasonably in handling the underlying claims. Because reasonableness was essential to the negligent-adjustment claim and had been actually litigated and resolved by a final judgment, the superior court should have granted summary judgment for the insurer and adjuster. The court vacated the jury verdict and judgment, reversed the superior court, and remanded for dismissal.
