Summary

The court held that municipal discretionary-function immunity protects planning and policy decisions but does not shield operational negligence in carrying out those decisions. It reversed summary judgment on Lane's negligent-supervision claim because the caretaker's supervision and instructions about alcohol were operational matters, and on the vicarious-liability claim because the evidence created a factual dispute about whether the caretaker acted within the scope of his employment. The court otherwise affirmed, including the conclusion that the City's decision not to provide additional security was an immune resource-allocation decision.
