Alaska Supreme Court
Recreational Data Services, Inc., Appellant v. Trimble Navigation Limited, a California Corporation, Appellee
March 24, 2017404 P.3d 120
Summary
The court held that the superior court improperly granted judgment notwithstanding the verdict because a reasonable jury could find that RDS proved misrepresentation, breach of the nondisclosure agreement, breach of fiduciary duty, partnership status, causation, and actual harm. The court nevertheless held that RDS's projected lost profits were not proven with reasonable certainty. It reversed the judgment, vacated the lost-profit award, and remanded for entry of nominal damages.
