Summary
The court held that the statutory fine-doubling provision applies to both criminal and noncriminal violations of Title 28 because contrary legislative history was insufficient to overcome the statute's plain language. It nevertheless held that the provision does not double statutory minimum fines, because the statute refers only to a fine or maximum fine and omits minimum fines. The court therefore affirmed the decision vacating Fyfe's doubled fine and remanded for imposition of the statutory minimum.
