Summary
The court held that the proposed initiative banning commercial set-net fishing in nonsubsistence areas would make a constitutionally prohibited appropriation of state salmon assets. Commercial set-netters constitute a distinct user group, and the initiative would both transfer salmon away from that group to other fisheries and eliminate the legislature's and Board of Fisheries' ability to allocate salmon to it. The court therefore reversed the superior court's order requiring certification.
