Alaska Supreme Court
State of Alaska, Division of Workers' Compensation, Petitioner v. Titan Enterprises, LLC; Titan Topsoil, Inc.; Cco…
November 28, 20142014 Alas. LEXIS 225
Summary
The Alaska Supreme Court held that non‑claimants may be awarded attorney’s fees when they are a successful party on appeal, and that when two non‑claimants both achieve success on significant issues, the Commission must consider both parties’ successes in determining any fee award. Accordingly, the Court reversed the Workers’ Compensation Appeals Commission’s fee award to Titan and remanded for further proceedings consistent with this opinion.
