Alaska Supreme Court

Grace L., Appellant v. State of Alaska, Department of Health & Social Services, Office of Children's Services, Appellee

July 18, 20142014 Alas. LEXIS 143

Summary

The Alaska Supreme Court affirmed the termination of Grace L.'s parental rights, concluding that substantial evidence supported the findings that her chronic untreated delusions endangered Ronnie, that she had not remedied the conditions placing him at risk, that Ronnie would likely suffer serious harm if returned to her custody, and that termination served his best interests. The court also held that OCS made active efforts under ICWA by arranging psychological and psychiatric evaluations, counseling, visitation, transportation, housing assistance, and parenting services, and that Grace failed to establish reversible error concerning counsel or judicial disqualification. Justice Stowers, dissenting in part, would have reversed and remanded because OCS did not adequately implement the recommended psychiatric treatment and monitor therapy.
